When eBay is the deemed supplier for VAT

The deemed-supplier rule applies transaction by transaction. eBay does not take over every seller's VAT obligations.

The marketplace is treated as supplier for qualifying distance sales of goods imported from outside the EU, regardless of where the underlying seller is established.

Non-EU seller with EU-held goods
The marketplace is treated as supplier where goods already in the EU are sold to an EU consumer by an underlying seller established outside the EU.

Irish or EU-established seller
For ordinary domestic and intra-EU sales of the seller's EU stock, the seller generally remains responsible for VAT unless another specific rule applies.
The books must identify which transactions eBay reported as marketplace-collected VAT. Otherwise the seller can account for the same VAT twice or omit VAT on sales that remain their own responsibility.

Low-value imports from 1 July 2026

A new customs duty applies to qualifying low-value packages sent directly to Irish consumers from outside the EU.

Most e-commerce packages valued at €150 or less sent directly to Irish consumers from outside the EU now carry a €3 customs duty per distinct HS-code product type from 1 July 2026.

Separate from VAT treatment
The duty is separate from VAT. Where IOSS is used, Revenue currently provides that no VAT is charged on the €3 customs duty itself; where IOSS is not used, the €3 duty can form part of the import-VAT calculation. A transaction can still use eBay's deemed-supplier or IOSS treatment for VAT while the new customs charge is reflected in the order, logistics or settlement data.

Returns note: where a consumer simply changes their mind and returns a qualifying low-value item, the €3 customs duty is generally not refunded by Customs. Different treatment may apply where goods are defective or non-conforming.

DAC7 reporting does not decide whether you owe tax

DAC7 requires platform operators to collect and report information about many sellers. eBay's report can place your seller identity, consideration, fees and activity directly within the tax-authority information exchange.

Sale-of-goods exclusion
A seller is excluded only where the platform facilitated fewer than 30 sale-of-goods activities and total consideration did not exceed €2,000 during the calendar year — note that exactly €2,000 still meets the exclusion. Both limits must be met simultaneously; either one alone is sufficient to make the seller reportable.

The platform files after the calendar year ends. The reportable seller must receive a copy of the information by 31 January.

DAC7 does not create a €2,000 exemption and does not prove that personal-item sales are a trade. The tax result follows the actual facts and profit.

From personal clear-outs to trading

Selling personal belongings is usually different from running a resale business. The distinction depends on what you do — not the label on the eBay account.

Personal disposals
Occasional sales of owned personal items, particularly at no profit, are unlikely to amount to a trade. The tax position depends on the facts of each sale. However, selling personal belongings may fall outside Income Tax trading rules while a disposal of certain valuable personal assets — such as antiques, jewellery or paintings — can still have separate Capital Gains Tax implications, subject to the relevant exemptions.

Commercial resale
Regularly buying or sourcing items to resell for profit, maintaining stock and operating a shop-like activity can amount to trading — regardless of the platform used.

Tax follows profit
Income Tax normally applies to trading profit after allowable costs — not automatically to the full value of every eBay payout or gross sales figure.
A person carrying on a trade through eBay should register for Income Tax self-assessment regardless of the amounts involved. The €5,000 taxable / €30,000 gross thresholds are particularly relevant in determining Form 11 treatment for individuals with additional non-PAYE income alongside employment, but they do not mean a trader can defer registration until those levels are reached. Smaller taxable profits still need to be declared through the appropriate Revenue route.

VAT routes for eBay sellers

The correct VAT route depends on where the seller is established, where stock is held, the nature of the buyer and the transaction type. More than one route can apply at the same time.

Second-hand goods and the margin scheme

Many eBay businesses resell used goods, collectibles or antiques. The normal VAT rules and the second-hand margin scheme can produce very different results.

Eligibility depends on the purchase source
The margin scheme can apply to qualifying goods acquired from private individuals or other eligible sources. It does not apply automatically to every used item sold on eBay. Critically, the scheme is not available for goods acquired under an ordinary VAT invoice where input VAT was deductible — goods purchased with recoverable VAT will generally require different treatment. Eligibility depends on both the type of goods and how they were acquired.

Where the scheme applies, VAT is calculated from the dealer's margin rather than the full selling price — a material difference for goods with a high purchase cost.

The seller needs evidence identifying the item, supplier, purchase price, sale price and scheme treatment for each transaction.

Invoice wording changes
A qualifying margin-scheme invoice does not show VAT separately and must include the required margin-scheme wording. Standard VAT invoicing does not apply.

Inventory and cost of goods sold

Stock purchased for resale is not always an immediate expense. Unsold stock remains an asset at year-end and is generally valued at the lower of cost and net realisable value under the applicable accounting framework (FRS 102, FRS 105 or IFRS). The cost of goods sold is matched to the items actually sold — not to everything purchased in the period.

The major-producer threshold is annual turnover above €1 million and 10 tonnes or more of packaging placed on the Irish market (the 10-tonne test includes exactly 10 tonnes). Other packaging duties can still apply below it.

Importing electrical products into Ireland for resale can make the business an EEE producer, even where goods carry someone else's brand. Producer registration, placed-on-market reporting and take-back/compliance obligations can therefore arise in addition to VAT and customs obligations. Retailer obligations may also apply separately.

Separate battery registration, reporting and recycling duties can apply, including batteries supplied inside another product such as a device or toy.

Recording the payout as sales
The payout is net cash. Sales, fees, refunds, holds and VAT must each be separated from the gross settlement figure.
Assuming eBay handles all VAT
The deemed-supplier rule applies only to specified transactions. Seller-liable sales still require the seller's own VAT accounting.
Accounting for marketplace VAT twice
eBay-collected VAT must be identified and removed before the seller's VAT return is prepared — or the seller pays it again.
Treating DAC7 as a tax-free threshold
The reporting exclusion does not decide whether the activity is taxable or constitutes a trade. Tax follows the actual facts and profit.
Using the margin scheme without purchase evidence
Eligibility depends on the goods, the purchase source and the records maintained — not simply on the item being used or second-hand.
Expensing every stock purchase
